Description

Subcontracting chains across the EU often involve multiple layers of contractors and subcontractors, frequently in cross-border contexts, which complicates enforcement, due to complicated subcontracting arrangements. This may result in a detriment of working conditions for workers. Authorities may face challenges in identifying responsible entities, accessing reliable company information, and enforcing sanctions against foreign operators. Accordingly, an effective design and application of the rules regulation subcontracting liability are important to safeguard the rights of workers. Following the European Commission’s report on the application and implementation of Directive (EU) 2018/957, ELA, together with the European Commission, launched a PLD series focused on subcontracting liability rules, within the framework of the POSTING 360 Programme.

The first peer learning dialogue (PLD) meeting was held on 03-04 July 2025, and this is the second PLD meeting. This PLD focuses on the implementation, monitoring, and enforcement of national liability mechanisms in subcontracting chains, including in cross‑border situations.
