Description

This workshop builds on a longer process launched in 2025, when the European Labour Authority (ELA), together with the European Commission, social partners and Member States, organised a series of three IMI‑PROVE workshops to explore practical challenges in enforcing posting rules, including remuneration, for posted drivers in the road transport sector.

These exchanges laid the groundwork for drafting the 3 part non-binding guidelines on enforcing remuneration, identifying key documentation, control practices and shared challenges across Member States.

Against this background, the workshop forms part of a continued series of activities organised under ELA’s mutual learning and understanding IMI‑PROVE programme, focusing on the effective enforcement of posting rules in road transport.

A key output of this work is the development of common, consolidated and non‑binding guidelines addressed to Member State authorities, social partners, operators and drivers. In line with ELA Founding Regulation (EU) 2019/1149, the guidelines aim to support a more consistent application and effective enforcement of EU rules, while complementing existing guidance adopted by the European Commission.

The workshop held on 20 April 2026 focuses on the documentation required to assess the remuneration of posted drivers, a core element of enforcement under Directive (EU) 2020/1057. It also summarizes the text of the first two parts of the draft guidelines on enforcing remuneration rules for posted drivers:

  • Guideline 1 – Controls of posting (Part I), covering roadside and back‑office checks, categories of posted drivers, required documentation (including Road Transport Posting Declarations, tachograph data and evidence of transport operations), and a proposed step‑by‑step control approach.
  • Guideline 2 – Documentation proving posting (Part II), detailing the evidence required to verify when and where posting took place, including tachograph records and consignment notes in freight transport/or journey forms and authorisations in passenger transport.

During the workshop, ELA continued the discussion aiming at drafting the third part of the guidelines, this time dedicated entirely to the labour-specific documentation, namely employment contracts, timesheets, proof of payments and payslips.

This workstream will continue until September, when the last workshop of the series shall take place.
