Description

This Peer Learning Dialogue (PLD) consisted of a series of discussions between a small group of Platform representatives and/or their nominated representatives to explore an issue in greater depth. The aim is to enhance cooperation and interaction and/or to find and implement practical solutions to a specific challenge in order to explore existing and new approaches for tackling undeclared work. 

This PLD on 'Bogus posting under social security rules' brought together labour inspectors and staff dealing with social security posting rules from EU Member States to share experiences, discuss good practices, and explore collaborative solutions to improve enforcement mechanisms, ensure proper verification and address the risks of fraudulent postings.

The PLD provided an opportunity for participants to reflect on the steps and processes that are needed to identify whether an exception to the lex loci laboris rule applies, and actions to be taken should irregularities be identified in the context of existing postings. The PLD provided a space to not only explore bogus posting from the perspective and through the experience of both sending and receiving Member States, but also to identify lessons learned to improve the effectiveness of posting rules in the future and enhance cooperation across the EU, particularly to verify whether posting conditions are met before and during the posting period. 

Participating countries: Belgium, Finland, Ireland, Norway, Slovenia, Spain and Portugal. Participants shared national practices, discussed improvements to existing mechanisms, and identified actions to be tested before the second (and final) meeting which will be on 24 March 2026 (online).
