The European Labour Authority supported a targeted cross-border joint inspection of road passenger transport on April 13, 2023, organised by the Slovenian supervisory authorities together with the German and Croatian enforcement authorities.

The control location was in a rest area in Slovenia, where all passenger traffic that takes place on the North-South axis can be intercepted. Companies established in Croatia, Bosnia and Herzegovina, Serbia, Bulgaria, and Slovenia were subject to supervision.

Over the past two years, Slovenian supervisory authorities have received many complaints regarding violations of regulations in the field of international road transport of passengers.

Based on the findings from inspections and several road accidents on Slovenian roads, which also involved vehicles used for international passenger transport, a broader, targeted, nationally and internationally coordinated inspection focusing on social legislation and implementation of the rules regarding international road passenger transport was carried out.

Identified infringements were in the field of technical roadworthiness, undeclared work, the operation of ‘international carriage’ in passenger transport contrary to the rules on authorisations, etc. In addition, infringements were found in the field of social legislation: working time, driving time and mandatory rest periods, the use of recording equipment and the provision of the required data.

The European Labour Authority was established in 2019 to help Member States and the European Commission to ensure that EU rules on labour mobility and social security coordination are enforced in a fair, simple and effective way. An important area of operation of the European Labour Authority is the sector of international road transport. With the EU mobility package (Mobility Package I) in 2020, new rules were introduced in the field of road transport, which ensure better protection of drivers and operators and help to ensure the fair mobility of transport workers. The new rules brought changes in the road transport sector and also new challenges in their practical application. It is one step to have the rules in place, the second step is to ensure that drivers and operators are informed about the rules, and a third, that the rules are enforced effectively. In connection with the above, the European Labour Authority provides the Member States operational support and assistance in preparation, coordination and follow-up of concerted and joint inspections, including by facilitating the exchange of information, translation of case-specific documentation and interpretation.
